The situation
You have moved abroad, or returned to France, or you work across two countries. You have filed your change of address, sometimes obtained a certificate of residence from the other State, and consider the matter settled.
The French tax authorities look at something else: where your family lives, where your work is carried out, where your income comes from. If they conclude that you are resident in France, tax is due on your worldwide income, with penalties for the missing returns.
What the rules say
You are a French resident under article 4 B if you meet any one of the following.
| Test | What it looks at |
|---|---|
| Home or main place of stay | where life is actually organised, starting with the family |
| Professional activity | carried out in France, unless ancillary |
| Centre of economic interests | where the main investments and the source of income are located |
Where two States each treat you as their resident, the treaty settles the question in order: permanent home, then centre of vital interests, then habitual abode, then nationality, and finally a mutual agreement procedure between the two administrations.
What the firm does with those rules
Before the move, the work is to build the evidence rather than hope for it: where the home will be, what must be closed in France, what may remain without shifting the centre of economic interests, and which documents to keep from the first year onwards.
It also means measuring the cost of the move itself: exit tax on shareholdings, the treatment of French-source income, and the reporting duties that survive departure.
If the position is challenged, each test is argued separately. The authorities must establish the one they rely on, and residence is not proved by an impression about someone’s standard of living.
Frequently asked questions
Can you have two tax residences?
Two States may each treat you as their resident under their own law. The treaty then designates a single State of residence for its purposes: that is what the hierarchy of tests is for.
How do you prove residence abroad?
Through a body of evidence: a certificate of residence from the other State, a lease or title deed, school enrolment for the children, a local employment contract, bank statements, utility consumption. One document is never enough.
How do you obtain a certificate of tax residence?
From the tax authorities of the State of residence, on the prescribed form. It is what allows treaty rates to be applied to withholding taxes.
Must a change of residence be reported?
Yes, and the year of departure calls for a specific return. It is also the year in which exit tax may be triggered.
